Has anybody got experience of live in care ?
I have made some enquiries about this and cost wise , it would be cheaper than the care home
I think my husband would also be happier back home
I have come to the conclusion that I wouldn’t cope on my own or even with carers coming in three times a day
So the other option would be live in care
But I could do with having opinions who have chosen that option either recently or currently
I hope some of you can share their thoughts with me
If your husband is severely disabled, have you asked for an NHS Continuing Care Assessment? Difficult to qualify, but then free care either at home or in residential care.
Yes he was getting chc and then some smart a…e from the nhs declared in their wisdom that he didn’t qualify for it any more
I have appealed but still waiting for a date for a ‘ resolution ‘ meeting
Then they need to show that his condition has improved significantly. Unlikely. Are you aware you can make a Subject Access Request for copies of their files?
No I don’t know what that is
Subject access request?
Willing to learn though !
Have a look at the Information Commissioner’s website for full details. We are entitled to see all computer records about ourselves, within about a month of asking. Then you might be able to see what they have been saying about his condition. The who, what, why, where and when.
It’s a very simple process to make a request. The Local Authority website should have details of how to make a request. You can make a request for yourself and if your husband has Capacity, he will need to sign or give authority for access to his records unless you have LPA in place. There is a strict time limit for them to respond (I think it is 42 days), unless they state there are specific reasons why it may take longer and if they fail to stick to the timeframe they can get into a lot of trouble. They also HAVE to present it in a suitable format for you (meaning no digital files unless you agree and if needed in large print etc they have to make allowances. Also any abbreviations used MUST be explained so they cannot hide behind their own “shorthand” to confuse). BB is right - it should give you access to all their ‘working papers’ and should explain how they arrived at the decision - IF they did a proper assessment - and if not then they have no defence and would have to reinstate the CHC.
Good luck
Hello
I don’t have power of attorney for health for my husband
And he hasn’t got capacity so what do I do ?
I am no expert but would you have to go through the Court of Protection? Worth consulting a Solicitor? Carers Legal Helpline. Hopefully someone else will be along soon who is more experienced.
Just look at the Information Commissioner’s website. Ask Google. I’ve rung various places like this and staff have always been very good.
