Where in the Care Act Guidance does it say this? It is hundreds of pages long and I don’t have time to look for it. Can you send me a link to that specific part?
It’s the fact that the guidance only refers to social workers and doesn’t say anything at all about self funders having to arrange everything. The duty of care falls on social workers, not families. Carers can choose what the can and cannot do. This includes arranging care.
As the care home placement was directly from hospital, and mats are needed, then surely they should be provided free, as a matter of urgency, as not to have them surely places dad in a potentially dangerous situation? The social worker needs to talk to the hospital and/or the OT. Make it very clear that if dad suffers any damage because they are not provided there may be a legal case as they were negligent. (They have a duty of care, breached that duty and there was resultant damage. This is the legal definition of negligence). Taking this thought further, if the mats had been provided after the first admission, would the later admissions have been needed?
