What are the issues regarding anyone with dementia amending thier will?

My mum often talks about amending her will. However, with her dementia diagnosis, will this be at all possible?

I don’t think it’s possible.

Not certain it’ll be possible as to make a Will a person needs to be able to clearly understand everything. With a dementia diagnosis it negates that. Might be worth checking with a solicitor in case there is any way to accommodate her, but not sure how to try to explain it to her if it’s not possible.

My Dad changed his Will after he had a diagnosis as my brother, with whom he was living and who had been given LPA (after Dad fell out with me) did not accept the diagnosis and convinced a solicitor he was OK !! I could have challenged it as he partially cut me out but it wasn’t worth falling out with siblings.

Why does mum want to change it? Under some circumstances a will can be changed AFTERsomeone has died, I think it’s called a Deed of Variation. Talk to a solicitor asap.

Depending on how badly your mum is affected by the dementia, she can still make changes to her will - but she’d need a solicitor to check that she has the mental capacity to make those changes, to ensure that it cannot be challenged. That adds significantly to the cost, but it’s pretty much the only way.
