Uc review & dla

so my family member is absolutly panicking to death and i just dont have any word of advice for her as i do not claim dla/benefits etc .. so they had their uc review had to send 4 months of bank statements plus their id and her bank account was clearly over the 6k mark from dec-march but not the extra one she sent from nov-dec , she has a child who is on top rate dla so her dla payments come in at £559 per month she hasent touched the dla payments wich has obv made her back account go over the 6k march so are they going to ask for her to send more bank statements in or can calculate it from the ones they can clearly see were she has gone over 6k without declaring also she’s trying to find out why her child’s dla money is classed as her capital if she hasent been touching that money for her personal things and needed to save a bit of that dla money up to try and get a room converted for her child as her child shares a room with siblings and this is not acceptable because their disabled child has anger issues and sensory issues were the other children sharing a room get hit and see walls get punched in please has anybody got advise or who can she call for advise thank you for reading

Hi @autism-mum

I suggest she contacts the Carers UK helpline:

For information and signposting, our telephone Helpline is available on 0808 808 7777 from Monday to Friday, 9am – 6pm (including Bank Holidays).

If you have a more complex query or would like more detailed guidance, we suggest you contact our email Helpline (advice@carersuk.org), as we’ll be able to provide more information.

or the Citizen’s Advice Bureau.

thank you we have both sat down and emailed them

How old is the child?

he is 10 with autism, adhd& tics

Is it in an entirely separate account?
If a child needs a separate bedroom they might be entitled to a Disabled Facilities Grant, but it’s vital work hasn’t started. Apply to the local housing authorit, not Social Services. Applying in April gives the best chance of success, as once the annual budget has gone, it’s gone!

no his money went in my account because he is a 10 year old child , they say moneys for the child and i hadent need to spend it on anything until i saved enough up to buy a car and try and get the bedrooms seperated for them , now my argument is am i going to get done by the uc for this and would they take into account it’s not my money

Maybe consider putting it in a separate account, in your name, but solely for the child?
It will save future problems.
I always recommend this to anyone who is appointee for an adult child unable to manage their own money, so there is a clear division of funds.

i’ve tried to get him is own account they wont allow it as he’s only 10 years of age , but clearly that’s his dla money wich states it on his letters that it’s not for me and i’m scared now there going to stop my uc money because obv i been saving his dla up in my account but can see ive not touched the money or spent it on my needs it’s his and was saving towards a big purchase for him a car is they any legal advice i could get on this or who do i contact

The account should be in YOUR name, as he is a minor, but you can ask for the full name on the account as “Mrs X In respect of Jonathan X”.
I can’t offer any good advice about how DWP will view you being over the limit, not anything that’s affected me. Someone else here may know more. You library may have a copy of the Disability Alliance Benefits Handbook. It’s very clear and easy to understand, but my copy is about 10 years out of date!
