Back payments Severe Disability Premium

In 2016 the High Court decided that back payments must be made to claimants who lost out on a Severe Disability Premium. Claimants were paid SDP retrospectively from the time they were either awarded Personal Independence Payments or transferred (as in my case) from Disability Living Allowance to PIP.

A friend said he received SDP back payments from when he was transferred from DLA to Pip about six years ago and received almost £20,000. I was transferred from DLA to PIP over a year ago and received, quite naturally, back payments of about six times less than my friend.

If only I had been transferred from DLA to PIP at the same time as my friend……

I understand but could be wrong, that claimants who were, and still are, receiving DLA are entitled to the Severe Disability Premium. Why then, if this is so, can’t claimants who were receiving DLA in 2016 receive the SDA back payments from that time?

It all seems so unfair, not only to me but thousands of others
