I’m thinking of appealing the decision against awarding ny mum CHC. Has anyone here appealed successfully? Any words of wisdom? Any do’s and don’ts? Did you do it through a specialist solicitor or yourself?
Thanks,
Look at Care to be Different.
I had to give up trying to reclaim £40,000 for mum. Nearly had a breakdown.
I appealed successfully. This was some years ago, maybe 2014 or 2015. I think it depends on your location and your mum’s problems. In our case the reps of social services and NHS all wanted my brother to get CHC. It seemed necessary to score high grades in three categories. The decisive grade was pointed out to me by a nurse - my brother (he was 80 and bedridden) was not capable of looking after his own health without me. So the question was: If left to himself, could he keep going? He was compos mentis but refused all physiotherapy and avoided taking his tablets if he had a chance. He was nice to his carers and popular with them, but also dependent on having things done for him.
Now this doesn’t really help you or explain anything, since it seems that people with dementia practically never get CHC.
But I would say, go through all the criteria with a fine tooth-comb. Are there specialist solicitors who could help?
I have also seen Care to be Different and it looks good, but I don#t think I saw it before appealing.
