I am helping my sister to get some advice for my adult nephew who has a schizophrenia. We are looking for signposting to find professional help/specialist services who provide support to carers of patients with schizophrenia regarding long-term planning, inheritance, and financial management. We are finding it quite hard to find the right help and would be grateful if anybody has experience of this kind of planning and any useful information to share on this.
hi @Bastille ,welcome to the fourm, You need to speak to a solicitor about it with Lasting power Atternoy it will help but also you need someone who deal with finaical’s as well. You could speak to mind who can help or contact the helpline.
I’ve been doing something similar. Here’s what I’ve been advised, just take it as something to think about before you see a good solicitor to arrange it all.
It is absolutely VITAL that he does not have access to over the DWP or Social Services limit for assistance, or they will expect him to pay for absolutely everything until it’s all gone.
Does he have mental capacity, in which case he can give you Power of Attorney. If not, you need to apply for Guardianship via the Court of Protection. See the Office of Public Guardian for details.
You can’t even leave it directly to him, it needs to be in something called a Discretionary Trust. So who will be his trustees?
Hi @Bastille
welcome to the forum.
I realise he hasn’t got a learning disability but Mencap have written information on this and webinars.
I agree with @bowlingbun it’s a minefield.
